Cognex Wants Inequitable Conduct Defense Barred

Law360, New York (April 13, 2010, 2:51 PM EDT) -- Machine vision software giant Cognex Corp. is urging a judge to preclude respondents in a Section 337 probe from pursuing their inequitable conduct claim, saying they are unable to offer a shred of evidence to support the accusation.

Evidence that a company withheld information during patent prosecution, as the respondents allege Cognex did, is not enough to prove intent to deceive patent examiners, according to a brief Cognex lodged Friday.
