Stryker Surgical Implant Kickback Suit Loses Legs

Law360, New York (April 14, 2010, 2:55 PM ET) -- Following a stipulation from the lead plaintiff, a federal judge has dismissed a putative class action against Stryker Orthopaedics accusing the company of violating competition law by offering kickbacks to health care providers who used its hip and knee implants.

Judge Jeffrey White of the U.S. District Court for the Northern District of California on Tuesday dismissed with prejudice a suit brought by Claire Haggarty under California's Unfair Competition Law accusing Stryker of unjust enrichment.

Haggarty's attorneys asked for the dismissal Friday.
