Comic Artist Kirby's Heirs Lose Bid To Toss Marvel Suit

Law360, New York (April 14, 2010, 6:02 PM EDT) -- A federal judge has refused to dismiss Walt Disney Co. unit Marvel Characters Inc.'s suit attempting to block the heirs of comic book artist Jack Kirby from terminating its rights to several superhero characters, including the Incredible Hulk, Spider-Man and the X-Men.

Finding that the two California-based Kirby children transacted business in New York by sending Marvel the termination notices there, Judge Colleen McMahon of the U.S. District Court for the Southern District of New York ruled Wednesday that she has jurisdiction over all the parties...
