PacifiCorp Settles Opacity Suit With $1M Payout

Law360, New York (April 16, 2010, 4:40 PM EDT) -- PacifiCorp has agreed to pay $1 million to settle a lawsuit brought by two environmental groups alleging violations of the opacity limits at a power plant in Wyoming.

Under a consent decree filed Thursday in the U.S. District Court for the District of Wyoming, PacifiCorp will pay a $1 million civil penalty to the U.S. Treasury and will apply to the state for a modification of its operating permit.

No startup or shutdown exception will apply for any boiler at the plant unless it is provided...
