Insurer's Claim Survives In Suit Over $5M Pecan Loss

Law360, New York (April 21, 2010, 1:33 PM EDT) -- A federal judge has rejected U.S. Pecan Trading Co. Ltd.'s dismissal bid for a General Insurance Company of America counterclaim alleging that U.S. Pecan shirked its obligation to cooperate in a General Insurance investigation stemming from a fire that U.S. Pecan said destroyed more than $5 million worth of nuts.

Judge David Briones of the U.S. District Court for the Western District of Texas signed off on an order denying U.S. Pecan's motion to dismiss the insurer's counterclaim on Monday.
