10th Circ. Reverses Enviro Win In Rio Grande Water Suit

Law360, New York (April 22, 2010, 6:40 PM EDT) -- A federal appeals court has overturned a successful challenge to the U.S. Bureau of Reclamation's procedures for allocating Rio Grande River water, a blow to environmental groups in a dispute over allowable use of water from the river and the protection of endangered species within.

A three-judge panel in the U.S. Court of Appeals for the Tenth Circuit on Wednesday vacated and remanded a district court's ruling in favor of the plaintiff-appellant environmental groups, with instructions to dismiss the case.
