CVS Asst. Managers Seek Conditional Cert. In OT Suit

Law360, New York (May 3, 2010, 3:00 PM EDT) -- The lead plaintiffs in an assistant store manager's wage-and-hour collective action against CVS Caremark Corp. have moved for conditional class certification in order to notify all potential opt-in class members of the pending lawsuit.

Original lead plaintiff William Nash and several opt-ins lodged the motion Wednesday in the U.S. District Court for the District of Rhode Island, where the case has been pending since February 2009.

The motion seeks first-stage certification to jump-start the issuance of notices to putative class members.
