Massive Medicaid Case To Stay In State Court

Law360, New York (January 17, 2007, 12:00 AM EST) -- A judge has rejected an argument that a state lawsuit accusing pharmaceutical companies of publishing false average wholesale prices for their drugs as a way to bilk Medicare should be tried in federal court.

In a ruling Tuesday, Judge Barbara B. Crabb of the U.S. District Court for the Western District of Wisconsin decided that Merck KgaA subsidiary, Dey, Inc., had not met its burden in showing that the case should be moved to federal court or that its request was timely.
