USPTO Panel Rejects Human Stem Cell Patent

Law360, New York (May 3, 2010, 6:06 PM EDT) -- The U.S. Patent and Trademark Office's Board of Patent Appeals and Interferences has rejected a patent on embryonic human stem cells held by the Wisconsin Alumni Research Foundation and challenged by two consumer groups.

The board on Wednesday reversed the findings of an earlier examination that had upheld the patentability of the technology, finding that the creation of human embryonic stem cell lines was obvious in light of work done in other species.
