Law360, New York (May 04, 2010, 1:32 PM ET) -- Down but not yet out, Jose Cuervo International Inc. has appealed a district court ruling that barred the tequila titan from using a red wax seal found to infringe Maker’s Mark Distillery Inc.’s trademark.
On Monday, Cuervo set its sights on the U.S. Court of Appeals for the Sixth Circuit, challenging the lower court’s finding in April that a high-end tequila adorned with a red wax seal treads too closely on the wax-dipped bottle that has become a symbol of Maker’s Mark bourbon products.
