US Misleads CIT On Canadian Drawbacks: Toyota

Law360, New York (May 7, 2010, 2:50 PM EDT) -- Toyota Motor Sales USA Inc. has accused the U.S. of using "red herrings" to misdirect the court in a trade case over drawback duties on three years' worth of car parts exported to Canada.

Toyota asked the U.S. Court of International Trade on Thursday to deny the government's cross-motion for summary judgment and instead grant summary judgment in its favor and hold that U.S. Customs and Border Protection improperly denied Toyota's request for duty drawback on the 42 entries at issue.
