Target Appeals Denial Of JMOL In Baby Stroller IP Suit

Law360, New York (May 10, 2010, 1:32 PM EDT) -- While a federal court earlier found that a baby stroller patent asserted against Target Corp. was unenforceable, the retail giant is still pushing to have the patent ruled obvious.

Target filed its notice of appeal Friday in the U.S. District Court for the Northern District of Texas. Inventor Albert T. Fairclough and his company Joovy LLC, which had accused Target of selling infringing Baby Trend Inc. strollers, in April appealed the court's unenforceability ruling.
