Merck, Glenmark Avoid Trial With Zetia Patent Deal

Law360, New York (May 10, 2010, 5:54 PM EDT) -- On the cusp of trial, Merck & Co. and Glenmark Pharmaceuticals Inc. have resolved a lawsuit over a patent for Merck's blockbuster cholesterol drug Zetia, with Glenmark getting permission to launch its proposed generic ahead of the asserted patent's expiration date.

Judge Jose L. Linares of the U.S. District Court for the District of New Jersey on Monday signed a consent judgment dismissing claims between Merck-owned Schering Plough Corp. and Glenmark, noting that the parties had signed a settlement agreement.
