Law360, New York (May 11, 2010, 12:51 PM ET) -- A federal appeals court has refused to reconsider a decision against police officers who filed a putative class action alleging the city of Mesa, Ariz., was required under the Fair Labor Standards Act to pay for time they spent donning and doffing uniforms and gear.
In a 2-1 decision, the U.S. Court of Appeals for the Ninth Circuit on Monday denied the police officers’ bid for a rehearing en banc or for a panel rehearing.
