Law360, New York (May 24, 2010, 1:58 PM EDT) -- When Congress enacted a Consumer Product Safety Improvement Act, amending the Consumer Product Safety Act, one of its goals was to increase enforcement of the CPSA. However, Congress recognized the limitations of the Consumer Product Safety Commission as the enforcer of CPSA. Therefore, in addition to private right of action already provided under CPSA, Congress also empowered states to enforce the federal consumer product safety regulations.
