Calif. Force-Placed Insurance Class Certified

Law360, New York (May 12, 2010, 3:21 PM EDT) -- A federal judge has certified a class action in California against American Security Insurance Co. over force-placed insurance, saying that the insurer's alleged coercive behavior could be reasonably construed to violate the state's Unfair Competition Law.

Judge Richard Seeborg of the U.S. District Court for the Northern District of California on Monday dismissed breach of statutory duty to disclose and constructive fraud claims against ASIC, but certified the class action with respect to the claim the company violated the unfairness prong of California's Unfair Competition Law....
