Power Plant Must Limit Visible Emissions: Wis. Court

Law360, New York (May 13, 2010, 3:48 PM EDT) -- In a win for the Sierra Club, an appeals court in Wisconsin on Thursday ruled that a coal-fired power plant must limit visible pollutants from its main smokestack, though the court rejected calls for tighter controls on other emissions.

The Wisconsin District Four Court of Appeals affirmed in part a lower court's decision that the Wisconsin Department of Natural Resources was correct in issuing a permit to the plant, but said the plant was not using the best available control technology for particulate matter.
