Colo. Regulator Fights Ruling In Qwest FCC Rules Suit

Law360, New York (May 14, 2010, 5:27 PM EDT) -- The Colorado Public Utilities Commission has appealed a ruling finding that the regulator incorrectly interpreted part of a federal rule determining when the telecommunications company must provide unbundled network elements to competitors such as Qwest Corp. at cost.

The utilities commission, along with defendant-intervenor Cbeyond Communications LLC, filed its notice of appeal to the U.S. Court of Appeals for the Tenth Circuit on Thursday, following a lower court's ruling in January that came down partly in favor of Qwest.
