Law360, New York (May 14, 2010, 5:15 PM ET) -- FTS USA LLC, which provides commercial and residential cable installation services, has defeated an attempt by a disgruntled employee to conditionally certify a dispute regarding overtime pay as a collective action under the Fair Labor Standards Act.
Judge J. Leon Holmes of the U.S. District Court for Eastern District of Arkansas issued the ruling Wednesday, saying the claims of Stephen Pressler were not similar to those of the proposed class because his work duties apparently included the responsibilities of two different positions.
