Ex-Dollar General CFO's SEC Relief Suit Allowed

Law360, New York (May 19, 2010, 7:02 PM EDT) -- Former Dollar General Corp. Chief Financial Officer Brian Burr has won an appeal of an injunction that barred him from pursuing a state court suit against the firm seeking reimbursement for penalties levied against him in a 2005 U.S. Securities and Exchange Commission accounting fraud action.

Nonparties to a consent decree do not have standing to enforce the decree, so the injunction should be vacated, a three-judge panel of the U.S. Court of Appeals for the Sixth Circuit ruled Wednesday.
