Motorola Says Panasonic Deceived USPTO About Chip IP

Law360, New York (May 25, 2010, 5:23 PM EDT) -- Motorola Inc. has fired a return shot in a Section 337 case from Panasonic Corp. Ltd. alleging infringement of chip patents, calling the patents invalid and accusing Panasonic of inequitable conduct during prosecution.

A attorney for Panasonic knew about critical prior art in 1999 and 2004, when the patents issued, but did not disclose the information to the U.S. Patent and Trademark Office, constituting intent to deceive the USPTO, Motorola said Monday in a 24-page answer to Panasonic's complaint.
