Fiber Maker Fails To Slay Body Armor Fraud Suit

Law360, New York (May 27, 2010, 2:03 PM EDT) -- A federal judge won't kill claims that Toyobo Inc. downplayed deadly defects in its Zylon fiber to induce bulletproof vest manufacturers to continue using the material, rejecting Toyobo's argument that a vest maker filed its fraud suit too late.

Judge Nathaniel M. Gorton of the U.S. District Court for the District of Massachusetts rejected on Tuesday Toyobo's bid to dismiss the fraud and deceptive trade practices complaint filed by First Choice Armor & Equipment Inc.
