Fed. Circ. Affirms $16M Win For Fuji In Camera IP Fight

Law360, New York (May 27, 2010, 3:52 PM EDT) -- A federal appeals court on Thursday affirmed a $16 million infringement award for Fujifilm Corp. in a patent battle over disposable cameras, rejecting the defendants' contention that a 2008 U.S. Supreme Court decision changed the doctrine of patent exhaustion in their favor.

The U.S. Court of Appeals for the Federal Circuit struck a blow to defendants Polytech HK, Jazz Products LLC and Jazz President Jack C. Benun, rejecting their patent exhaustion argument and ruling that the royalty awarded to Fuji was not excessive.
