Investors Appeal Dismissal Of BSC Stent Fraud Case

Law360, New York (May 28, 2010, 11:56 AM EDT) -- The Mississippi Public Employees Retirement System has challenged a ruling throwing out a consolidated securities fraud class action claiming Boston Scientific Corp. failed to notify shareholders of major issues with its Taxus stent.

The plaintiffs signaled their intent to appeal a ruling handing summary judgment to Boston Scientific, representing the second time the case has gone before the U.S. Court of Appeals for the First Circuit, according to a notice of appeal filed Thursday.
