FWS Must Rethink Delta Smelt Protection Plan: Court

Law360, New York (May 28, 2010, 4:16 PM EDT) -- A federal court has ruled the U.S. Fish and Wildlife Service will have to reconsider a plan to alter water supply projects to protect California’s delta smelt fish, though it declined to enjoin the plan without firm evidence that the fish is not within imminent risk.

The San Luis & Delta-Mendota Water Authority and the Westlands Water District have shown a likelihood of success based on the merits of their claims against the government, the U.S. District Court for the Eastern District of California said Thursday....
