Green Group Loses Appeal Against Calif. Business Park

Law360, New York (June 2, 2010, 5:20 PM EDT) -- A federal appeals court has given the go-ahead to the development of a 700-acre business park in Redding, Calif., on threatened species' habitat, upholding a lower court decision.

Chico, Calif.-based Butte Environmental Council did not persuade the court that federal agencies had granted permits for the project in a way that was arbitrary or capricious, the U.S. Court of Appeals for the Ninth Circuit said in an opinion issued Tuesday.
