EPA Seeks Comments On New Pesticide Permit Rule

Law360, New York (June 3, 2010, 4:52 PM EDT) -- The U.S. Environmental Protection Agency has proposed a new permit requirement aimed at decreasing pesticides in the nation's waters, in response to an appeals court ruling that pesticides are not exempt from the Clean Water Act's permitting program.

The EPA proposed a draft on Wednesday of the National Pollutant Discharge Elimination System permit, which would require pesticide users to use the lowest effective amount of pesticide and calibrate equipment to detect adverse incidents.
