Fed. Circ. Deems Purdue's Tramadol Patents Invalid

Law360, New York (June 03, 2010, 5:37 PM ET) -- Purdue Pharma Products LP has lost its appeal of a district court ruling that the company's patents for tramadol are invalid, clearing the way for Par Pharmaceuticals Inc. to market a generic version of the painkiller.

The U.S. Court of Appeals for the Federal Circuit on Thursday upheld a district court's ruling that Purdue's U.S. Patent Numbers 6,254,887 and 7,074,430 were obvious in light of earlier patents for controlled-release formulations of tramadol including U.S. Patent Number 5,580,578, known as the Oshlack patent.
