Law360, New York (June 04, 2010, 4:23 PM ET) -- A former sales representative for KV Pharmaceutical Co. subsidiary Ther-Rx Corp. who claims the company gave her short shrift on overtime pay has asked a federal judge to conditionally certify her case as a collective action.
Leslie Robertson filed a motion in the U.S. District Court for the Middle District of Alabama on Thursday asking the judge overseeing the case to authorize the matter to proceed as a collective action, and make Ther-Rx fork over contact information and Social Security numbers for all potential opt-in plaintiffs....
