Iovate Trims Claims In $13.5M Hydroxycut MDL Case

Law360, New York (June 7, 2010, 4:56 PM EDT) -- Iovate Health Sciences USA Inc., the maker of Hydroxycut dietary supplements, has knocked out allegations of fraud and infliction of distress in a $13.5 million suit accusing it of misrepresenting the safety of Hydroxycut to consumers.

Judge Barry Ted Moskowitz of the U.S. District Court for the Southern District of California said Thursday that plaintiff Jessica Rogoff had not pled fraud with requisite particularity, and had failed to state a claim on additional allegations of negligent infliction of emotional distress and intentional infliction of emotional distress....
