Tying Suit Against Amgen Over Blood Drug Tossed

Law360, New York (June 7, 2010, 7:19 PM EDT) -- A federal court has dismissed an antitrust lawsuit Warren General Hospital brought against Amgen Inc. for unlawfully tying discounts and rebates on its white blood cell growth factor products to purchases of a red blood cell growth factor product known as Aranesp.

As an indirect purchaser, the hospital lacks standing to bring such a suit, Judge Stanley Chesler of the U.S. District Court for the District of New Jersey ruled Monday.
