3rd Circ. Tosses Pa. Beryllium Exposure Class Actions

Law360, New York (June 8, 2010, 6:16 PM EDT) -- A federal appeals court has affirmed the dismissal of two putative class actions that sought medical monitoring for workers and nearby residents of factories in Pennsylvania that used beryllium, exposure to which can lead to a potentially fatal disease.

The U.S. Court of Appeals for the Third Circuit issued the ruling Monday, affirming the lower courts' ruling because, at least in part, some lead plaintiffs were not genetically predisposed to developing the potentially fatal disease.
