3rd Circ. Backs Insurer In St. Croix Airport Pollution Suit

Law360, New York (June 09, 2010, 3:46 PM ET) -- Reliance Insurance Co. need not defend or indemnify a Devcon International Corp. subsidiary in a lawsuit over dust pollution stemming from a runway expansion project at a U.S. Virgin Islands airport, a federal appeals court has affirmed.

The U.S. Court of Appeals for the Third Circuit on Tuesday sided with the insurer, finding that a pollution exclusion in the commercial general liability policy at issue barred Devcon unit VI Cement & Building Products Inc. from coverage in the underlying litigation.
