Schering Loses Bid To Split Suit Over Generic Vytorin

Law360, New York (June 11, 2010, 2:50 PM EDT) -- A federal judge has rejected Schering Corp.'s request to bifurcate its patent suit against Mylan Pharmaceuticals Inc. over a generic version of cholesterol drug Vytorin so that the plaintiff's infringement claims are decided before antitrust counterclaims.

Judge Jose Linares of the U.S. District Court for the District of New Jersey on Thursday denied Schering's motion to bifurcate, ruling that granting the bid would violate Mylan's constitutionally guaranteed right to a jury trial.
