Del. Court Ruling Could Aid Chinese Drywall Insureds

Law360, New York (July 6, 2010, 10:26 AM EDT) -- A recent Delaware Supreme Court insurance ruling regarding defective plumbing adds clarity to the debate over how to determine an occurrence under certain policies, and some say the decision could favor policyholders, including those involved in expansive litigation over defective Chinese drywall.

In the June 3 ruling, the court held that 469,000 claims stemming from a defective plumbing product, Delrin, constituted one occurrence, allowing DuPont Co., which already paid $239 million to cover the claims, to reach coverage under an excess insurance policy.
