Law360, New York (June 14, 2010, 7:29 PM ET) -- A state court judge on Monday threw out the commonwealth of Pennsylvania's suit alleging that Johnson & Johnson unit Janssen Pharmaceutica Inc. had improperly marketed the antipsychotic drug Risperdal, and an attorney for Pennsylvania vowed to appeal.
Judge Frederica Massiah-Jackson of the Philadelphia Court of Common Pleas granted Janssen's motion for a nonsuit on Monday morning, J&J spokesman Greg Panico told Law360.
