Patriot Coal Mine On The Hook For Selenium Waste

Law360, New York (June 16, 2010, 1:43 PM EDT) -- A federal judge has determined that a West Virginia coal mine is violating its discharge permits, ruling in favor of environmental groups in their dispute with Patriot Coal Corp. subsidiary Hobet Mining LLC.

Judge Robert Chambers of the U.S. District Court for the Southern District of West Virginia on Monday denied Hobet's efforts to dismiss the case and determined that the mine was not cleaning up harmful selenium that it was discharging into nearby streams and was unlikely to remediate the problem absent litigation.
