P&G Hit With False Patent Marking Suit Over Floss

Law360, New York (June 17, 2010, 6:35 PM EDT) -- Herengracht Group LLC has accused Procter & Gamble Co. of falsely marking two dental floss products with expired patents, alleging that the consumer goods giant has wrongfully quelled competition.

Florida-based Herengracht filed an amended complaint Thursday in the U.S. District Court for the Southern District of California, arguing that P&G has wrongfully advertised patent monopolies by marking its products with expired patents.

The result is that consumers have been harmed in an amount that cannot be readily determined, the complaint says.
