5th Circ. Throws Out Green Group's Wind Farm Suit

Law360, New York (June 18, 2010, 1:07 PM ET) -- A federal appeals court has upheld Texas' decision to let the construction of a coastal wind farm go forward without hearings, overruling a local environmental group that argued federal law requires public consultation.

The Coastal Zone Management Act provides no private cause of action that would allow Houston-based Coastal Habitat Alliance to force the state to hold hearings, the U.S. Court of Appeals for the Fifth Circuit said Thursday.
