Law360, New York (June 23, 2010, 1:40 PM ET) -- A federal judge has refused to allow plaintiffs in the multidistrict litigation against Bayer Corp. over its blood-clotting drug Trasylol to appeal an order barring one of their proposed experts from testifying.
Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida ruled Tuesday that his order barring the witness, medical expert Suzanne Parisian, wasn't appealable because there was no “controlling question of law as to which there is a substantial ground for difference of opinion.”
