Respironics Apnea Patent Ruled Valid But Not Infringed

Law360, New York (June 23, 2010, 1:34 PM EDT) -- A federal judge has handed a partial victory to each side in a patent dispute between Invacare Inc. and Respironics Inc., two companies that make treatments for sleep apnea.

Judge Gary L. Lancaster of the U.S. District Court for the Western District of Pennsylvania ruled Monday that Invacare did not infringe Respironics' patent, U.S. Patent Number 6,105,575, but rejected Invacare's claim that both the '575 patent and another Respironics patent — U.S. Patent Number 6,609,517 — were invalid.
