ITC Says Toyota Must Face Hybrid Patent Suit

Law360, New York (June 24, 2010, 4:51 PM ET) -- The U.S. International Trade Commission has barred Toyota from challenging a patent owned by hybrid technology researcher Paice LLC, saying the patent's validity has already been established by a federal court.

The commission also denied Toyota's request to throw out the case entirely, in two separate orders made public Wednesday.

The ITC voted in October to investigate Paice's claim that Toyota violated Section 337 of the Tariff Act of 1930 by importing and selling certain hybrid electric vehicles and components that infringe a patent.
