7th Circ. Upholds Remand Of Bayer Trasylol Suits

Law360, New York (June 24, 2010, 5:46 PM EDT) -- Bayer Corp. has lost a bid to appeal the remand of four nearly identical Illinois lawsuits over blood-clotting drug Trasylol back to state court despite its arguments that the cases should proceed together as a mass action in federal court.

The U.S. Court of Appeals for the Seventh Circuit denied Bayer's bid for appeal Tuesday, rejecting Bayer's argument that the plaintiffs had manipulated the pleadings in order to avoid federal jurisdiction under the Class Action Fairness Act.
