1st Circ. Rejects Airport Tenant's Antitrust, RICO Claims

Law360, New York (June 24, 2010, 7:09 PM EDT) -- A federal appeals court has rejected an antitrust and Racketeer Influenced and Corrupt Organizations Act suit brought by an aviation services company accusing a Massachusetts airport commission of barring competitors from selling jet fuel at the airport.

Plaintiff Rectrix Aerodrome Centers Inc.'s antitrust claim, “dubious on the merits,” is barred by the state action doctrine, a three-judge panel ruled in the U.S. Court of Appeals for the First Circuit on Wednesday.
