Credit Card Cos. May Be Liable For Gucci Fakes: Judge

Law360, New York (June 25, 2010, 5:11 PM EDT) -- In what attorneys called the first opinion of its kind, a federal judge has held that three credit card processors may be held liable for trademark infringement for doing business with a website that admitted selling counterfeit Gucci America Inc. products.

Judge Harold Baer Jr. of the U.S. District Court for the Southern District of New York refused to dismiss Gucci's suit Wednesday, finding that Frontline Processing Corp., Woodforest National Bank and Durango Merchant Services LLC may have contributed to infringement of the fashion house's trademarks....
