Facebook Defense OK'd In Data Storage IP Suit

Law360, New York (June 28, 2010, 5:26 PM EDT) -- A federal judge has allowed Facebook Inc. to bring an inequitable conduct counterclaim in Leader Technologies Inc.'s infringement suit over a patent for managing and storing electronic information, finding that the social networking website did not wait too long to raise the claim.

Judge Leonard Stark of the U.S. District Court for the District of Delaware on Thursday granted Facebook’s motion to amend its pleadings to add an inequitable conduct defense, but denied its bid to amend a false marking claim.
