Judge Reverses Return Of Disclosed E-mails

Law360, New York (February 2, 2007, 12:00 AM EST) -- A judge in a New Jersey patent case has reversed a magistrate judge’s order forcing the defendants to return over 500 mistakenly disclosed confidential documents.

Judge Jose L. Linares found on Wednesday that the magistrate judge’s decision was based on a factual error, and reversed and remanded the decision to the judge for further consideration.

Amersham Biosciences Corp. has been trying to retrieve 579 e-mails that were erroneously included on CDs with over 800,000 other documents provided to PerkinElmer Inc. two years ago.
