2nd Circ. Overturns US Foodservice Exec's Conviction

Law360, New York (July 1, 2010, 5:22 PM EDT) -- An appeals court has overturned the conviction of U.S. Foodservice Inc.'s former marketing chief, saying the jury was given improper instructions in the case over an $800 million accounting fraud at the company.

A three-judge panel of the U.S. Court of Appeals for the Second Circuit said Thursday also said the trial court judge shouldn't have allowed hearsay testimony during the trial of Mark Kaiser, who was an executive at the former Royal Ahold NV subsidiary.

The court vacated Kaiser's conviction and sent the case back...
