US Salmon Co. Wants Duties On Norwegian Rival

Law360, New York (July 2, 2010, 1:52 PM EDT) -- Domestic salmon producer Cooke Aquaculture Inc. has sued the U.S. Department of Commerce over its decision to spare a Norwegian competitor anti-dumping duties, claiming the agency’s recent tariff review relied on wholly flawed data.

The complaint, lodged Thursday in the U.S. Court of International Trade, claims that Commerce mishandled the changed circumstances review for Nordic Group AS in 2009 and improperly concluded that the company had the same supplier and customer bases as its corporate predecessor Nordic Group A/L, meriting the same 0 percent duty rate...
