Dutch High Court Orders Review Of Trafigura CEO Case

Law360, New York (July 6, 2010, 3:55 PM EDT) -- A Dutch court must reconsider its finding that Trafigura Beheer BV CEO Claude Dauphin cannot be prosecuted for transporting toxic waste to the Ivory Coast, the Netherlands' highest court ruled Tuesday.

The Netherlands' Supreme Court decided that the lower court in Amsterdam had misinterpreted the European Union's waste shipment regulation when it found that the public prosecutor did not have enough evidence to support a case against Dauphin.
